Terms and Conditions

Please read these terms before requesting a quotation or confirming a booking with Wanderlust Travel & Tours.

1. About Wanderlust Travel & Tours

Wanderlust Travel & Tours (“WTT”, “I”, “me” or “my”) is a sole-proprietor travel-planning and booking service based in Windhoek, Namibia, owned and operated by Carmen Louw.

WTT is registered with the Namibia Tourism Board as a booking office under registration number BOO01050.

2. Acceptance of these Terms

These Terms and Conditions apply when you:

  • use this website;
  • request travel-planning or booking services;
  • accept a quotation or itinerary;
  • instruct WTT to make a reservation;
  • pay a planning fee, deposit or other amount; or
  • otherwise confirm a booking in writing or electronically.

By doing so, you confirm that you have read and accepted these Terms and Conditions. If you make a booking on behalf of other travellers, you confirm that you are authorised to accept these terms on their behalf and that you will share all relevant information with them.

3. Services and role of WTT

WTT provides personal travel planning, itinerary preparation and booking support for travel in Namibia and selected Southern African destinations.

Depending on the agreed service, this may include:

  • itinerary planning and travel consultation;
  • accommodation reservations;
  • vehicle rental arrangements;
  • transfers and activities;
  • self-drive, guided or fly-in travel arrangements; and
  • bookings made through tour operators or other travel suppliers.

Unless expressly stated otherwise, WTT acts as an intermediary between the traveller and independent suppliers such as accommodation establishments, airlines, vehicle-rental companies, activity providers, transfer companies and tour operators.

The actual travel services are supplied by these third parties and are subject to their own terms, availability, cancellation policies and operational requirements.

4. Quotations and availability

All quotations and proposed itineraries are subject to availability at the time of booking.

A quotation does not constitute a confirmed reservation. No booking is confirmed until:

  • WTT has received your written approval;
  • all required traveller information has been supplied;
  • the required planning fee or deposit has been received in cleared funds; and
  • the relevant suppliers have confirmed the requested services.

Quoted rates may change before confirmation due to supplier increases, exchange-rate movements, taxes, levies, park fees, fuel costs or other circumstances outside WTT’s control.

WTT will inform you of a material price change before proceeding wherever reasonably possible.

5. Travel-planning fees

A travel-planning or consultation fee may apply for tailor-made itinerary research and preparation. The applicable fee and included services will be communicated before work begins.

Planning fees compensate WTT for professional time, research and itinerary preparation. Unless otherwise agreed in writing, a planning fee:

  • becomes payable before detailed planning begins;
  • may cover a specified number of proposals or revisions;
  • is separate from amounts payable to travel suppliers; and
  • is non-refundable once the planning work has commenced, except where required by law.

Where expressly stated in the quotation, part or all of the planning fee may be credited towards a confirmed full booking made through WTT.

Additional planning, major itinerary changes or repeated revisions outside the agreed scope may be charged separately, subject to your approval.

6. Prices, currency and taxes

Prices will normally be quoted in Namibian dollars, South African rand, US dollars, euros or another currency used by the relevant supplier.

Unless stated otherwise:

  • prices are based on the number of travellers and services shown in the quotation;
  • bank charges and foreign-exchange costs are for the traveller’s account;
  • payments must be made in the currency stated on the invoice;
  • WTT is not responsible for exchange-rate differences or charges imposed by banks or payment providers; and
  • WTT is not currently registered as a VAT vendor, and VAT is therefore not added to WTT’s own service fees.

Taxes or levies charged by third-party suppliers may already be included in their rates or may be payable separately.

7. Deposits and payments

The required deposit, payment schedule and final payment date will be stated in the quotation or invoice.

Bookings may be cancelled automatically if payment is not received by the applicable deadline. WTT is not responsible for the loss of a reservation or any resulting price increase caused by late payment.

Payments are only considered received once they reflect as cleared funds in the nominated bank account.

You must verify the bank details on the invoice before making payment. WTT will not be responsible for payments made to an incorrect or fraudulent account where the traveller failed to confirm suspicious or changed payment instructions directly with WTT.

8. Amendments requested by the traveller

Requests to change a confirmed booking must be submitted in writing.

All changes remain subject to supplier availability and approval. Supplier amendment fees, fare differences, additional service costs and WTT administration fees may apply.

A significant change to the route, dates, destination, number of travellers or style of travel may require a revised quotation or a new planning fee.

9. Cancellations by the traveller

Cancellations must be submitted to WTT in writing and are effective only once acknowledged by WTT.

Cancellation charges are determined by:

  • the cancellation conditions of each supplier;
  • the timing of the cancellation;
  • any non-refundable deposits or services already paid for;
  • bank and currency-conversion charges; and
  • work already completed by WTT.

Some bookings, including certain flights, promotional rates, park permits, activities and peak-season reservations, may be partly or entirely non-refundable.

Any refund due will only be processed once the relevant supplier has returned the funds to WTT. Supplier fees, WTT fees, bank charges and exchange-rate losses may be deducted from the refund to the extent permitted by law.

WTT strongly recommends comprehensive travel insurance that includes suitable trip-cancellation cover.

10. Supplier changes and cancellations

Travel arrangements may be changed or cancelled by suppliers because of weather, road conditions, safety concerns, mechanical problems, operational requirements, overbooking, government action or other circumstances.

Where a supplier makes a significant change, WTT will provide reasonable assistance in obtaining an alternative service or any refund offered by that supplier. Any alternative may be subject to availability and additional costs.

WTT cannot guarantee that an alternative of the same price, location or standard will be available.

11. Passports, visas and entry requirements

Each traveller is responsible for ensuring that they have:

  • a valid passport with sufficient validity and blank pages;
  • all required visas, permits and travel authorisations;
  • the correct documents for children travelling across borders;
  • vaccination certificates or other health documentation;
  • suitable driving licences and cross-border documents; and
  • complied with immigration, customs and entry requirements for every destination.

Information supplied by WTT is general guidance only. Requirements may change without notice, and travellers must verify current requirements with the relevant embassy, consulate, immigration authority, airline or other official source before travelling.

WTT is not responsible for loss, delay, refusal of entry or additional costs arising from incomplete or incorrect travel documents.

12. Health and fitness

Travellers are responsible for assessing whether they are medically and physically fit for their chosen journey.

You must disclose any medical condition, disability, dietary requirement or mobility limitation that may affect the booking or require special arrangements. WTT will pass relevant requirements to suppliers but cannot guarantee that every request can be accommodated.

Travellers should obtain appropriate medical advice regarding vaccinations, medication, malaria prevention and other health risks before departure.

13. Travel insurance

Comprehensive travel insurance is strongly recommended and may be required for certain bookings.

Appropriate cover should include, where applicable:

  • trip cancellation and interruption;
  • emergency medical treatment and evacuation;
  • repatriation;
  • baggage and personal belongings;
  • vehicle-rental excess;
  • missed connections and travel delays; and
  • activities included in the itinerary.

WTT does not provide insurance advice and is not responsible for the adequacy, exclusions or outcome of any insurance policy or claim.

14. Traveller conduct and responsibility

Travellers must comply with the reasonable rules, safety instructions and codes of conduct of suppliers, guides, accommodation establishments, protected areas and local authorities.

A supplier may refuse or terminate a service where a traveller’s conduct is unsafe, unlawful, abusive or disruptive. In such cases, refunds are not guaranteed, and the traveller will be responsible for resulting costs.

Travellers are responsible for any damage, loss, fines or penalties caused by their actions.

15. Wildlife and outdoor travel

Travel in Southern Africa may involve remote areas, wildlife, gravel roads, variable weather and limited access to medical or communication services.

Wildlife sightings, weather conditions, road conditions, water levels and natural events cannot be guaranteed. Travellers voluntarily accept the ordinary risks associated with their selected itinerary and must follow all safety instructions.

16. Force majeure

WTT will not be responsible for a failure, delay, change or cancellation caused by circumstances beyond its reasonable control.

These may include severe weather, floods, fire, drought, epidemics, pandemics, war, civil unrest, terrorism, border closures, government restrictions, strikes, fuel shortages, transport disruption, natural disasters or similar events.

Any refund, credit or postponement will depend on the terms and decisions of the relevant suppliers. Additional costs resulting from such events are for the traveller’s account, subject to applicable law and available insurance cover.

17. Complaints during travel

Any problem must be reported immediately to the relevant supplier and to WTT so that there is a reasonable opportunity to address it.

If the matter is not resolved during the journey, a written complaint should be submitted to WTT within 14 days after completion of the trip, together with supporting documents.

Failure to report a problem promptly may limit the ability of WTT or the supplier to investigate or resolve it.

18. Liability

WTT will perform its own services with reasonable care and skill.

However, WTT does not own, manage or control independent travel suppliers and is not responsible for their acts, omissions, insolvency, service standards, delays or failures, except to the extent that liability cannot lawfully be excluded.

To the fullest extent permitted by law:

  • WTT is not liable for indirect, incidental or consequential loss;
  • WTT is not liable for loss arising from inaccurate information supplied by the traveller;
  • WTT is not liable for circumstances outside its reasonable control; and
  • any liability relating to WTT’s own services will be limited to the fees paid directly to WTT for the affected service.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

19. Personal information

WTT collects and uses personal information needed to prepare quotations, make bookings, communicate with travellers and fulfil legal or administrative obligations.

This information may include passport details, contact information, dietary requirements, health-related requirements and payment records. Relevant information may be shared with suppliers, tour operators, border authorities or service providers, including parties located outside Namibia, where necessary to arrange the requested travel.

Travellers booking on behalf of others confirm that they have permission to provide those individuals’ personal information.

20. Website information

WTT makes reasonable efforts to keep the information on this website accurate and current. However, destination information, rates, entry requirements, operating schedules and supplier services may change without notice.

Website content is provided for general information and does not constitute a confirmed offer or guarantee.

WTT is not responsible for the content, security or availability of third-party websites linked from this website.

21. Intellectual property

Unless otherwise stated, the text, branding, itinerary content, layout and original material on this website belong to WTT and may not be copied, republished, distributed or used commercially without prior written permission.

Photographs may belong to WTT, suppliers or licensed third parties and remain subject to the rights of their respective owners.

A personalised itinerary may be used by the traveller for the booked journey but may not be copied, resold or commercially distributed.

22. Electronic communication

You agree that quotations, invoices, confirmations, notices and other documents may be provided by email, WhatsApp or another agreed electronic method.

You are responsible for supplying accurate contact details and checking messages regularly. Electronic acceptance, written booking instructions and electronic payments may constitute valid confirmation of a transaction, subject to applicable law.

23. Governing law and disputes

These Terms and Conditions are governed by the laws of the Republic of Namibia.

The parties should first attempt to resolve any dispute through good-faith discussion. If the dispute cannot be resolved, it will be subject to the jurisdiction of the competent courts of Namibia, unless applicable law requires otherwise.

24. Changes to these Terms

WTT may update these Terms and Conditions from time to time. The version applicable to a booking will ordinarily be the version accepted when that booking was confirmed, unless a legal or regulatory change requires otherwise.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
